
On December 15, 2022 at approximately 10:40 P.M. Marshall County Central Dispatch received a phone call of a
vehicle that had driven off the road on US 31 in the area of 5A Rd. Marshall County Police responded to the scene.
Upon arrival, a deputy spoke with the driver of the vehicle, identified as Kenneth Rose-Rustman of South Bend, and
believed him to be under the influence of alcohol. The deputy conducted field sobriety tests and determined him to be
intoxicated. He was taken into custody and transported to the Marshall County Jail where he was booked and charged
with Operating a Motor Vehicle While Intoxicated with a BAC above .15, and for Operating a Motor Vehicle While
Intoxicated Endangerment.
Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that
a crime has been committed and that there is only probable cause to believe a crime has been committed. They are
presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by
jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be
made.
